1. Program Description
The Chez Bacchus SMS text messaging program (the “Program”) is operated by Chateau Hospitality Collection, Inc., a California corporation doing business as Chez Bacchus (“Chez Bacchus,” “we,” “us,” or “our”), located at 743 E. 4th St., Long Beach, CA 90802. By enrolling in the Program, you agree to receive recurring automated promotional and personalized marketing text messages from Chez Bacchus to the mobile phone number you provide at opt-in.
Messages may include:
- Reservation confirmations, reminders, and updates;
- Event and tasting announcements (including Chef’s Table, Afternoon Tea, and seasonal menus);
- Special offers, promotions, and VIP Club communications;
- Review and feedback requests after your visit;
- Important operational notices (such as closure or last-minute schedule changes).
2. Consent and Opt-In
By providing your mobile phone number and opting in through any of the following methods, you expressly consent to receive text messages from Chez Bacchus:
- Checking the SMS consent box on our website forms (including reservation inquiries, VIP Club signup, and private event inquiries);
- Providing your phone number and opting in through our chat widget;
- Texting a designated keyword to our shortcode or long code;
- Verbally opting in at the restaurant with staff confirmation.
Consent is not a condition of any purchase. You can enjoy Chez Bacchus without enrolling in the SMS Program.
Before enrolling, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you are the owner or authorized user of the mobile number you provide.
3. Message Frequency
Message frequency varies based on the types of messages you receive and your activity with our restaurant. You should generally expect to receive no more than a few messages per week, though frequency may increase around events, holidays, or major announcements.
4. Message and Data Rates
Message and data rates may apply. Chez Bacchus does not charge for the messages you receive through the Program, but your wireless carrier may charge you for sending and receiving text messages, depending on your mobile plan. Please check with your carrier regarding any applicable fees.
5. How to Opt Out
You can cancel the SMS Program at any time. To stop receiving messages, reply STOP to any message from us. You will receive a one-time confirmation message confirming your opt-out. After that, you will not receive additional messages from the Program.
If you wish to rejoin the Program at any time, you can opt back in using any of the opt-in methods described in Section 2.
If you change or disconnect your mobile phone number, please notify us promptly so we can update our records and avoid sending messages to an unintended recipient.

7. Supported Carriers
The Program is available on most major U.S. wireless carriers, including AT&T, T-Mobile (including Sprint), Verizon Wireless, U.S. Cellular, Cricket, and most regional carriers. Carriers are not liable for delayed or undelivered messages.
The Program may not be available on all mobile carriers. T-Mobile is not liable for delayed or undelivered messages.
8. Compatible Devices
The Program requires a compatible mobile device with SMS-enabled service. Standard text messaging is supported; delivery of multimedia (MMS) messages is dependent on your device and carrier.
9. Privacy
We respect your privacy. Information collected through the SMS Program is used solely to operate the Program and deliver the communications you have consented to receive. We do not share your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent information are not sold, rented, or transferred to any third party.

10. Disclaimer of Warranty
The Program is provided on an “as is” basis. Chez Bacchus does not warrant that the Program will be uninterrupted, timely, secure, or error-free, and we are not responsible for delayed, undelivered, or incorrectly delivered messages.
11. Changes to the Program
We may modify or terminate the Program or these SMS Terms at any time, with or without notice. Your continued participation after any changes constitutes your acceptance of the updated terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These SMS Terms, and any dispute or claim (whether contractual or non-contractual) arising out of or relating to these SMS Terms or the Program, are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles, and, where applicable, the federal Telephone Consumer Protection Act (TCPA) and its implementing regulations.
12.2 Venue
Except for disputes subject to binding arbitration under Section 12.4 below, you and Chez Bacchus agree that any action, suit, or proceeding arising out of or relating to these SMS Terms or the Program shall be brought exclusively in the state courts of Los Angeles County, California, or the United States District Court for the Central District of California, and you and Chez Bacchus consent to the personal jurisdiction of, and waive any objection to venue in, those courts.
12.3 Informal Dispute Resolution
Before filing a claim against Chez Bacchus related to the Program, you agree to try to resolve the dispute informally by sending a written notice of the dispute (“Notice”) to Chez Bacchus at 743 E. 4th St., Long Beach, CA 90802, or by email to info@chezbacchus-lb.com. The Notice must describe the nature and basis of the claim, the specific relief sought, and your name, address, and contact information. We will attempt to resolve the dispute informally. If the dispute is not resolved within sixty (60) days after the Notice is received, either party may commence an arbitration proceeding or, where permitted, file a claim in court.
12.4 Binding Arbitration; Class Action Waiver
Except for the matters described in Section 12.5 below, any dispute, claim, or controversy arising out of or relating to the Program or these SMS Terms — including any claim under the TCPA or any state equivalent — shall be resolved by final and binding arbitration, rather than in court, on an individual basis only. The arbitration will be administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures (or its Comprehensive Arbitration Rules and Procedures for claims exceeding $250,000), and will be conducted in Los Angeles County, California, by a single neutral arbitrator. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
You and Chez Bacchus each agree that any dispute resolution proceeding shall be conducted only on an individual basis, and not in a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding. You and Chez Bacchus each knowingly and voluntarily waive the right to a trial by jury. If the class-action or jury-trial waiver is found unenforceable, the entirety of Section 12.4 shall be null and void, but the remainder of Section 12 shall remain in full force and effect.
12.5 Exceptions
Either party may (a) bring an individual action in small claims court for disputes within that court’s jurisdiction; or (b) seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights, confidential information, or trade secrets.
12.6 30-Day Right to Opt Out
You have the right to opt out of the binding arbitration and class-action waiver provisions in Section 12.4 by sending written notice of your decision to opt out to info@chezbacchus-lb.com or to 743 E. 4th St., Long Beach, CA 90802, within thirty (30) days after you first enroll in the Program. Your notice must include your full name, mailing address, mobile number enrolled in the Program, and a clear statement that you wish to opt out of binding arbitration. If you opt out, disputes will be resolved in the courts identified in Section 12.2; all other provisions of these SMS Terms remain in full force and effect.
12.7 Survival
This Section 12 shall survive any termination of your participation in the Program or these SMS Terms.
