1. Acceptance of Terms

Welcome to Chez Bacchus. These Terms of Service (“Terms”) constitute a binding agreement between you and Chateau Hospitality Collection, Inc., a California corporation doing business as Chez Bacchus (“Chez Bacchus,” “we,” “us,” or “our”), and govern your use of our website at chezbacchus-lb.com (the “Website”) and any services, content, or features offered through the Website or provided at our restaurant located at 743 E. 4th St., Long Beach, CA 90802.

By accessing or using our Website, making a reservation, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or services.

2. Use of the Website

You agree to use our Website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Website. You agree not to:

  • Attempt to gain unauthorized access to any part of the Website or our systems;
  • Use automated means (bots, scrapers, crawlers) to access the Website without our express written permission;
  • Transmit any viruses, malware, or harmful code;
  • Interfere with or disrupt the Website or servers connected to the Website;
  • Copy, reproduce, or redistribute content from the Website without permission;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

3. Intellectual Property Rights

All content on this Website — including text, graphics, photographs, logos, the Bacchus medallion, menu content, videos, and the overall design — is the property of Chez Bacchus or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

“Chez Bacchus,” the Bacchus medallion logo, and related marks are trademarks of Chez Bacchus. You may not use these marks without our prior written permission.

You may view, download, and print content from the Website for personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, without our prior written consent is prohibited.

4. Reservations and Cancellations

Making a Reservation

Reservations may be made through our OpenTable booking page, by phone at (562) 336-1440, or in person. All reservations are subject to availability and confirmation.

Cancellation Policy

We kindly ask that you notify us of any cancellations or changes to your reservation at least 24 hours in advance. Late cancellations and no-shows may result in a fee charged to the credit card on file, particularly for:

  • Parties of six or more guests;
  • Special events, including Chef’s Table experiences and Afternoon Tea;
  • Holiday reservations and private dining bookings.

Specific cancellation terms and any applicable fees will be communicated at the time of booking.

Late Arrivals

We will hold your table for up to 15 minutes past your reservation time. After that, we reserve the right to release the table to accommodate other guests. Please contact us as soon as possible if you are running late.

5. Private Events and Deposits

Private events, buyouts, and group bookings may require a deposit to secure the date. Deposit amounts, payment schedules, cancellation terms, and minimum spend requirements will be detailed in a separate Private Event Agreement provided at the time of booking.

Deposits are generally non-refundable unless otherwise specified in your Private Event Agreement. Cancellations within a specified window prior to the event may result in forfeiture of the deposit or additional charges.

6. Gift Cards

Chez Bacchus gift cards may be purchased in person at the restaurant or through authorized channels. Gift cards:

  • Are redeemable only at Chez Bacchus for food and beverages;
  • May not be redeemed for cash, except where required by law;
  • Are non-refundable and non-replaceable if lost or stolen;
  • Have no expiration date, consistent with California law.

Unused balances remain on the card. Please treat gift cards like cash.

7. The Bacchus VIP Club

Membership in The Bacchus VIP Club is subject to approval and may be modified, suspended, or terminated at our discretion. Benefits, including priority reservations, members-only tastings, and special offers, are subject to availability and may change without notice.

By joining the VIP Club, you consent to receive communications from us about membership benefits, events, and exclusive offers. You may opt out of marketing communications at any time.

8. Food, Allergens, and Dietary Information

While we take great care in preparing every dish and can accommodate many dietary restrictions and allergies with advance notice, our kitchen handles common allergens including dairy, eggs, soy, wheat, peanuts, tree nuts, fish, and shellfish. We cannot guarantee that any menu item is completely free from cross-contact with allergens.

Guests with severe food allergies or medical conditions should inform their server before ordering. You assume all risk of exposure to allergens when dining with us.

Menu items, prices, availability, and sourcing are subject to change based on seasonality and supply.

9. Disclaimer of Warranties

Our Website and services are provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, Chez Bacchus disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Information on the Website, including menu items and pricing, may contain errors or omissions and is subject to change without notice.

10. Limitation of Liability

To the fullest extent permitted by law, Chez Bacchus, its owners, employees, officers, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website or our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid to us in connection with the transaction giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Chez Bacchus and its owners, employees, officers, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your use of the Website, or your conduct while dining at our restaurant.

12. Governing Law, Venue, and Dispute Resolution

12.1 Governing Law

These Terms, and any dispute or claim (whether contractual or non-contractual) arising out of or relating to these Terms, our Website, our services, or your interactions with us, are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

12.2 Venue and Jurisdiction

Except for disputes subject to binding arbitration under Section 12.4 below, you and Chez Bacchus agree that any action, suit, or proceeding arising out of or relating to these Terms, the Website, our services, or your visit to our restaurant shall be brought exclusively in the state courts of Los Angeles County, California, or the United States District Court for the Central District of California, and you and Chez Bacchus consent to the personal jurisdiction of, and waive any objection to venue in, those courts.

12.3 Informal Dispute Resolution

Before filing a claim against Chez Bacchus, you agree to try to resolve the dispute informally by sending a written notice of the dispute (“Notice”) to Chez Bacchus at 743 E. 4th St., Long Beach, CA 90802, or by email to info@chezbacchus-lb.com. The Notice must (a) describe the nature and basis of the claim, (b) set forth the specific relief sought, and (c) include your name, address, and contact information. We will attempt to resolve the dispute informally. If the dispute is not resolved within sixty (60) days after the Notice is received, either party may commence an arbitration proceeding or, where permitted, file a claim in court.

12.4 Binding Arbitration

Except for the matters described in Section 12.6 below, any dispute, claim, or controversy arising out of or relating to these Terms, the Website, our services, your interactions with us, or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved by final and binding arbitration, rather than in court. The arbitration will be administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures for claims of $250,000 or less, or its Comprehensive Arbitration Rules and Procedures for claims exceeding that amount (in each case as in effect at the time arbitration is commenced). The arbitration will be conducted by a single neutral arbitrator in Los Angeles County, California, or, if you so elect and your claim is $25,000 or less, by telephone, videoconference, or on the basis of written submissions alone. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this Section 12.4.

12.5 Class Action and Jury Trial Waiver

You and Chez Bacchus each agree that any dispute resolution proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. You and Chez Bacchus each knowingly and voluntarily waive the right to a trial by jury in any action or proceeding related to these Terms. If this class-action or jury-trial waiver is found to be unenforceable, then the entirety of Section 12.4 (Binding Arbitration) shall be null and void, but the remainder of Section 12 shall remain in full force and effect.

12.6 Exceptions to Arbitration

Notwithstanding Section 12.4, either party may (a) bring an individual action in small claims court for disputes within that court’s jurisdiction; (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or trade secrets; and (c) file suit in a court of competent jurisdiction to address claims of intellectual property infringement.

12.7 30-Day Right to Opt Out

You have the right to opt out of the binding arbitration and class-action waiver provisions in Sections 12.4 and 12.5 by sending written notice of your decision to opt out to info@chezbacchus-lb.com or to 743 E. 4th St., Long Beach, CA 90802, within thirty (30) days after you first accept these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of binding arbitration. If you opt out, disputes will be resolved in the courts identified in Section 12.2, but all other provisions of these Terms will remain in full force and effect.

12.8 Survival

This Section 12 shall survive any termination of your use of the Website or these Terms.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The updated Terms will be posted on this page with a revised “Effective date.” Your continued use of the Website after changes are posted constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
